Terms of travel

The legally binding version is in Swedish. In case of discrepancy, the Swedish text prevails.
These general and special terms of travel apply to tours operated by Northbound MC Adventures (NORTHBOUND MC Adventures). The general terms are based on the agreement between the Swedish Consumer Agency and the Swedish Travel and Tourism Industry Federation (SRT, 1993-02-02). NORTHBOUND MC Adventures's special terms supplement the general terms where the latter do not contain a provision.
1. The agreement
1.1. The organiser is liable to the traveller for what the traveller is entitled to under the agreement, including services performed by third parties. The lead traveller is the person who books the tour and enters into the agreement with NORTHBOUND MC Adventures. All changes and cancellations must be made by the lead traveller. Co-travellers must request changes through the lead traveller.
1.2. Information on NORTHBOUND MC Adventures's website, in catalogues and brochures is binding on the organiser. The organiser may change information before an agreement is entered into if an express reservation is stated and the traveller is clearly informed.
1.3. The organiser shall keep the traveller informed of matters of significance relating to the agreement.
1.4. Add-on services (e.g. own transport to the departure point, extra accommodation or equipment) are part of the agreement only if sold or marketed together with the main arrangement at a joint price or linked prices.
1.5. The agreement is binding when the organiser has confirmed the booking in writing and the traveller has paid the agreed deposit within the agreed time. The organiser shall confirm the booking without delay.
2. The traveller's right to cancel
2.1. The traveller may cancel according to the following:
2.1.1. More than 90 days before departure — full refund.
2.1.2. Thereafter but more than 30 days before departure — fee of 10% of the tour price.
2.1.3. Thereafter but more than 24 hours before departure — fee of 80% of the tour price.
2.1.4. Within 24 hours of departure — full tour price is payable.
If the traveller fails to appear at the agreed time and place, or cannot participate due to missing required documents (e.g. valid motorcycle licence, approved insurance), NORTHBOUND MC Adventures may charge the full tour price.
Changes that alter route, departure point, duration, departure time, accommodation or price are treated as cancellation and a new booking, with fees according to 2.1.1–2.1.4. Cancellation is deemed to have occurred when notice is received by NORTHBOUND MC Adventures.
2.2. The traveller may cancel without fee if the traveller, spouse/partner, close relative or person who booked together is affected by serious illness, worsened medical condition or accident making travel unreasonable, or if another serious event (e.g. fire at home) occurs after the agreement became binding and was beyond the traveller's control.
2.2.1. Cancellation must be made as soon as possible. Grounds must be documented with medical and/or relationship certificates.
2.3. Cancel by email to pelama@gmail.com or via the website contact form. For urgent cancellation outside office hours, send email as soon as possible; the time of receipt applies.
2.4. Amounts due to the traveller shall be refunded promptly after cancellation.
3. Transfer of the agreement
3.1. The traveller may transfer the agreement to someone who meets all participation requirements, e.g. valid motorcycle licence and required riding ability. The organiser must be notified in reasonable time before departure.
3.2. On transfer, transferor and transferee are jointly liable to NORTHBOUND MC Adventures for remaining payment and any extra costs caused by the transfer, up to SEK 500.
4. Changes before departure and cancellation by the organiser
4.1. The organiser may change terms to the traveller's disadvantage only if clearly stated in the agreement. Price increases are allowed only if the agreement clearly states how the new price is determined.
NORTHBOUND MC Adventures may cancel if too few participants register (minimum 4 required), if the tour leader is ill, or due to force majeure beyond the organiser's control.
4.2. The traveller may withdraw if the organiser materially breaches the agreement or terms change materially to the traveller's disadvantage. The organiser shall notify the traveller promptly. The traveller must notify withdrawal within a reasonable time or lose that right.
4.3. If the traveller withdraws under 4.2, they are entitled to a replacement tour of equal or higher quality if offered. If a lower-quality replacement is accepted, compensation for the price difference applies. If no replacement is offered, paid amounts shall be refunded promptly.
4.4. In cases under 4.3, reasonable compensation may be due. No compensation for cancellation if NORTHBOUND MC Adventures shows fewer than the minimum (4 persons) registered and the traveller was notified at least 14 days before departure (10 days for tours up to 5 days), or if the tour could not run due to circumstances beyond the organiser's control.
4.5. Cost increases after a binding agreement may lead to price increases for transport, taxes/fees or exchange rates — only if the increase exceeds SEK 100. No price increase in the last 20 days before departure. Corresponding price reductions apply for cost decreases.
4.6. Either party may withdraw if disaster, war, general strike or other serious event at or near the destination materially affects the tour. Swedish Ministry for Foreign Affairs recommendations apply.
NORTHBOUND MC Adventures may terminate participation without refund if the traveller rides recklessly endangering life, or rides under the influence of alcohol or drugs. No further financial claims against NORTHBOUND MC Adventures arise from such termination.
5. Changes after departure, defects and deficiencies
5.1. If a material part of agreed services cannot be provided after departure, the organiser shall arrange suitable alternatives at no extra cost. If not possible or reasonably refused, equivalent transport back to the departure point or another agreed location shall be provided. If this worsens the tour, price reduction and compensation may apply.
5.2. For other defects, price reduction and compensation apply unless caused by the traveller. The organiser is not liable for circumstances beyond reasonable control.
5.3. Compensation covers financial loss, personal injury and property damage. The traveller shall mitigate loss where possible.
6. Complaints and remedies
6.1. The traveller shall notify NORTHBOUND MC Adventures within a reasonable time after discovering or should have discovered a defect, preferably during the tour.
6.2. Notwithstanding 6.1, defects may be claimed if the organiser acted with gross negligence or in bad faith.
6.3. Valid complaints shall be handled promptly. Written complaints must reach NORTHBOUND MC Adventures within one month of return via pelama@gmail.com or the website contact form.
7. Traveller responsibilities during the tour
7.1. The traveller shall follow instructions from the tour leader and organiser, respect rules of conduct and not disturb others. Material breach may lead to termination of the agreement.
7.2. The traveller is liable for damage to the organiser caused by negligence, including failure to follow instructions.
7.3. The organiser provides relevant health and formal requirements where applicable. The traveller is responsible for a valid motorcycle licence, required insurance, approved equipment and other formalities. Costs from missing formalities are borne by the traveller unless caused by incorrect information from the organiser.
7.4. The traveller must have the riding ability required for the tour and terrain. NORTHBOUND MC Adventures may deny participation if the tour leader assesses a safety risk — without refund under 4.6.
7.5. A traveller who deviates from the arrangement after departure must inform the tour leader. No compensation applies for unused parts of the tour.
8. Dispute resolution
Parties should attempt to resolve disputes by negotiation. Failing agreement, disputes may be referred to the Swedish National Board for Consumer Disputes (ARN) or a general court.
9. Booking confirmation and travel documents
The traveller is responsible for checking the booking confirmation. Errors or misunderstandings must be reported immediately. Material commitments must be noted in writing in the confirmation to be binding.
10. Payment
Deposit (10% of the amount) is due within 7 days of receiving booking confirmation. Final payment must reach NORTHBOUND MC Adventures at least 30 days before departure. Payment details are provided in the confirmation.
If the traveller fails to pay as agreed, NORTHBOUND MC Adventures may terminate the agreement.
NORTHBOUND MC Adventures reserves the right to correct errors in prices and information on the website before a binding agreement is entered into.
